In a latest Judgement of Supreme Court the issue is discussed whether an Arbitrator has power to award pendente lite interest, when contract contains bar for grant of interest in a case covered by the Arbitration Act, 1940.
If the arbitrator and the parties involved enjoy any of the relationships mentioned in the Seventh Schedule of the Act, then that arbitrator cannot be appointed.
