Amendment in IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016

In exercise of the powers conferred by clause (t) of sub-section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations on 5th October, 2018 to amend the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016.

The Insolvency and Bankruptcy Board of India (IBBI) notified on 5th October, 2018 the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Fourth Amendment) Regulations, 2018.

Amendment in Liquidation Process under IBC

In exercise of the powers conferred by clause (t) of subsection (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby made the regulations further to amend the Insolvency and Bankruptcy Board of India (Liquidation Process) Regulations, 2016 on 22nd October 2018. These regulations may be called the Insolvency and Bankruptcy Board of India (Liquidation Process) (Second Amendment) Regulations, 2018.

  1. In the Insolvency and Bankruptcy Board of India (Liquidation Process) Regulations, 2016 (hereinafter referred to as the principal regulations), for regulation 32, the following regulation shall be substituted, namely: - "32. Sale of Assets, etc.

Insolvency and Bankruptcy Board of India issues Insolvency and Bankruptcy Board of India ( Mechanism for issuing Regulations) Regulations, 2018 on 22nd October, 2018.

    Public Consultation

  1. For the purpose of making regulations, the Board shall upload the following, with the approval of the Governing Board, on its website seeking comments from the public
    1. draft of proposed regulations;
    2. the specific provision of the Code under which the Board proposes regulations;
    3. a statement of the problem that the proposed regulation seeks to address;
